96% of all civil cases are settled PRIOR to trial.

Fees are $5000 per day - - based upon a 10 hour day. Billing is in 1/2 day increments. (please also see Refund info below)

In the event travel is required, travel time is billed at $275 per hour.

Terms of Payment
In the event dispute surrounds $20,000 or less each party involved in dispute must forward money order, cashiers check, or cash amounting to an equal divided share of 5 hour minimum (1/2 day). (Example: Dispute is $18,000. We can normally wrap such matters in less than 5 hours. Therefore if there are 2 parties involved each party must bring cash or cash equivalent of $1250. If 3 parties were involved in the dispute, each party would bring cash or cash equivalent of $833.) If time runs beyond the 5 hours allotted, we will bill all parties equally for remaining balance. Each party is jointly and severally liable for excess billing and must sign acknowledgment of same.

MONIES ARE DUE IN OUR OFFICE AT LEAST 3 BUSINESS DAYS PRIOR TO THE COMMENCEMENT OF THE ARBITRATION EVENT

In the event dispute involves between 20 and 80 thousand dollars, parties shall bring cash or cash equivalent of 7 1/2 hours or $3750.

If dispute exceeds $80,000, parties shall bring cash or cash equivalent of $5000. This figure represents a 10 hour day.

If arbitration runs into a 2nd day (which is extremely rare), cash or cash equivalent must be brought in at the start of the 2nd day or attorneys must sign agreements of liability for billing in addition to disputing parties’ previous acknowledgement of joint and several liability for any excess billing.

Refunds
In the event time to arbitrate a dispute results in fewer hours than anticipated, a refund check will be issued within 5 business days to disputants based on the pro rata share of each disputant’s original fee payment. This “refund” check shall be for the overage of hourly billing collected up front. HOWEVER, arbitration events are billed at 1/2 day minimum; which means that if the process including pre-arbitration documentation, information, consulting after the initial consultation, combined with work spent on the process and arriving at the resolution only takes 4 hours, there will be no refund of the 5th hour. After the 5th hour, time is billed in 30 minute increments.

Time is billed in 30 minute increments. Thus if a matter is handled in 5 hours and 56 minutes, billing will be for 6 hours. Time of 5 hours 10 minutes would be billed as 5 and ˝ hours, and so forth.

CLIENTS UNDERSTAND, DISPUTE RESOLUTION WILL NOT WORK UNLESS ALL PARTIES HAVE SOME LEVEL OF AGREEMENT TO HAVE THE DISPUTE ARBITRATED.

We are known for our extreme FAIRness. We are highly qualified in understanding disagreements and extremely capable of arriving at fair solutions to disputes. Additionally, no refunds will take place on appointments cancelled within 72 hours of agreed upon meeting time. (cancellation must be more than 3 days prior to the appointment)

Pre-arbitration with the exception of the initial consultation, is billable time. However, in most cases this time is less than 90 minutes.

We are very efficient with the use of time and can normally achieve agreement between parties in the above time allotments.

Are there cheaper people? Yes. However, what now takes us 4 or 5 hours to settle, many cheaper mediators take 2 or 3 times longer to settle an issue with a large percentage FAILING to achieve a satisfactory resolution to the dispute, settlement therefore bringing about the wasting of time and money - the exact opposite of what clients are attempting to accomplish.

As long as there is general agreement regarding child custody (if any) and asset division, most divorce arbitrations can be handled within one half day.

If arbitration runs above the initial 5 hours, parties are responsible for payment for those hours.

Refunds

“Refunds” are for the overage of hourly billing collected up front. If payment for services was made by more than 1 party, then each writer of the payment will receive a refund proportional to their percentage originally contributed. We cannot write refunds to any individual other than that original payer.
